By placing an order, making a booking, paying a deposit or using our services, you acknowledge that you have read, understood and agreed to the following Terms of Service.
1. Bookings & Deposits
A 50% deposit is required to secure and confirm your booking. Your date and requested items are not considered booked until the required deposit has been received and confirmed by Ebony Ivory Event Hire.
The remaining balance must be paid by the due date provided in your booking confirmation.
All prices and quotes are subject to the details provided at the time of enquiry. Changes to the event, venue, guest numbers, styling requirements or hire items may result in additional charges.
2. Payments & Fees
Payments made through our website may incur a 2.9% payment processing surcharge.
Additional fees may apply depending on your booking, including but not limited to:
- Delivery and collection fees
- Setup and pack-down fees
- Stairs or difficult-access fees
- Late collection fees
- Additional labour
- Last-minute changes
- Custom styling or design requests
- Damage or replacement costs
Any additional charges will be communicated to the client where reasonably possible.
3. Cancellations & Changes
Deposits and payments made to secure a booking are non refundable.
Where permitted by Ebony Ivory Event Hire, a cancelled booking may be transferred into a credit/voucher valid for 24 months, subject to availability and any applicable conditions.
Changes to your booking must be requested as soon as possible. Changes are not guaranteed and may incur additional fees.
4. Hire Items
All hire items remain the property of Ebony Ivory Event Hire unless otherwise stated.
Hire items must be used only for their intended purpose and must be returned in the same condition in which they were supplied.
The client is responsible for the hire items from the time of delivery/setup or collection until they are returned to Ebony Ivory Event Hire.
5. Damage, Loss & Replacement
The client may be responsible for the cost of repair or replacement of any hire items that are damaged, lost, stained, broken or missing while in their care.
This includes damage caused by guests, children, pets, weather, food, drinks, candles, adhesives or incorrect use.
Replacement or repair costs may be charged to the client where applicable.
6. Outdoor Events & Weather
For outdoor events, the client is responsible for ensuring that the event area is suitable and safe for the installation and use of our equipment and styling items.
Certain items, including balloons, backdrops, florals, signage and decorative installations, may be affected by wind, rain, heat, direct sunlight or other weather conditions.
Ebony Ivory Event Hire cannot guarantee the condition or longevity of outdoor styling where weather conditions may affect the products.
We reserve the right to modify, relocate or remove an installation where we reasonably believe conditions are unsafe or may cause damage.
7. Balloons
Balloons are delicate decorative products and may naturally lose air or change appearance over time.
Balloons may be affected by heat, cold, sunlight, wind, sharp objects, rough handling and environmental conditions.
Ebony Ivory Event Hire is not responsible for balloon damage occurring after installation or collection where the damage is outside our control.
Colour variations may occur due to lighting, photography, screen settings and supplier availability.
8. Styling & Design
Images provided by clients for inspiration are used as a guide only.
We will make reasonable efforts to recreate the requested style, colour palette and overall aesthetic; however, exact products, flowers, colours, textures and materials may vary due to supplier availability, seasonal availability and manufacturing differences.
Where substitutions are necessary, Ebony Ivory Event Hire will aim to provide a suitable alternative of a similar standard.
9. Venue Access & Client Responsibilities
The client is responsible for providing accurate venue information, including:
- Full venue address
- Access instructions
- Loading zones
- Parking information
- Stairs or lift access
- Setup and pack-down times
- Venue restrictions
- Relevant venue contact details
Failure to provide accurate information may result in delays or additional fees.
The client is responsible for obtaining any required venue approvals or permissions for styling, installations, balloons, candles, signage or other hire items.
10. Delivery, Setup & Collection
Delivery times are estimated and may be affected by traffic, venue access, weather, previous bookings or circumstances outside our reasonable control.
The client must ensure that the venue is accessible at the agreed delivery and collection time.
A late collection fee of $65 may apply where items are not ready for collection at the agreed time or where our team is required to wait.
A stairs/access fee of $65 may apply where additional labour is required due to stairs or difficult access.
Additional charges may apply for extended waiting times, restricted access or circumstances that significantly increase the time required to complete the booking.
11. Candles & Open Flames
Where candles are supplied, they must be used responsibly and in accordance with venue requirements.
Candles must never be left unattended and should be kept away from children, flammable materials and other hazards.
The client is responsible for following all venue rules and safety requirements relating to candles and open flames.
12. Photography & Portfolio
Ebony Ivory Event Hire may photograph completed styling and events for use on our website, social media, advertising and portfolio.
If you do not wish your event to be photographed or shared, please notify us in writing before your event.
13. Force Majeure
Ebony Ivory Event Hire will not be liable for failure or delay in providing services where this is caused by circumstances beyond our reasonable control, including severe weather, natural disasters, accidents, venue closures, transport disruptions, supplier failures, illness, government restrictions or other unforeseen circumstances.
We will make reasonable efforts to communicate with the client and provide an alternative solution where possible.
14. Liability Disclaimer
To the extent permitted by law, Ebony Ivory Event Hire is not responsible for loss, damage, injury or expense arising from the misuse of hire items, unsafe conduct by guests, venue conditions, weather conditions, or circumstances outside our reasonable control.
Nothing in these Terms excludes, restricts or modifies any rights or guarantees that cannot legally be excluded under applicable Australian Consumer Law.
15. Quotes & Pricing
Quotes are based on the information supplied by the client at the time of enquiry.
Quotes may change if the requirements of the booking change, including changes to quantities, venue, delivery location, setup requirements, styling, labour or hire period.
A quote does not constitute a confirmed booking. A booking is only confirmed once the required deposit has been received.
16. Acceptance of Terms
By proceeding with a booking, paying a deposit or making payment to Ebony Ivory Event Hire, the client confirms that they have read and accepted these Terms of Service.
These Terms apply to all bookings unless otherwise agreed to in writing by Ebony Ivory Event Hire.
